About these terms

These Terms of Service (“terms”) are an agreement between you and Servicios Comerciales Clickbuy, S de RL de CV (“Zurvey”, “we” or “us”), with its address at Av. Ignacio L Vallarta 3300-Piso 2, Vallarta Nte., 44690 Guadalajara, Jalisco, México. They apply to the Zurvey app at app.zurvey.co, to forms published with Zurvey and to this website.

By creating an account, publishing a form or subscribing to Pro, you accept these terms. Our Privacy Policy explains how we handle personal data, and the Pricing page shows current plans, prices and limits.

People who only answer a form don’t need an account and don’t enter into this agreement with us by answering. The form’s creator is responsible for their form and for what they do with the answers.

Who can use Zurvey

You must be at least 18 years old and able to enter into a binding agreement to create an account. If you use Zurvey for a company or organization, you confirm that you have authority to accept these terms on its behalf.

Using Zurvey for business doesn’t remove consumer protections that the law gives you.

The service

Zurvey lets you create forms and surveys, publish them with a link, collect responses and files, see results and send responses to tools you connect. You can start building before signing up; you need a verified free account to publish and collect responses.

The features included in each plan are described on the Pricing page. We improve Zurvey over time and may change or remove features. If a change materially reduces a paid feature you use, we will tell you in advance when practicable.

Your account and its security

Give us accurate information and keep it up to date. Keep access to your email account and your Google account secure, since we use them to sign you in. You are responsible for activity in your account. If you believe someone accessed it without permission, tell us at hello@zurvey.co right away.

Accounts are personal. Invite other people to your workspace instead of sharing your sign-in.

Workspaces and roles

Forms, responses, files, integrations and subscriptions belong to a workspace. Each workspace has an Owner and can have Editors and Viewers:

• the Owner manages billing, members and connections to other services;
• Editors build and manage forms and responses; and
• Viewers can see forms and responses without changing them.

A Free workspace has one member. A Pro workspace can have up to five members in total. The Owner is responsible for who has access to the workspace and for the use members make of it.

Your content

You keep ownership of the forms you create and the responses and files you collect (“your content”). We don’t claim ownership of it.

You give us a worldwide, non-exclusive, royalty-free permission to host, store, copy, process, transmit and display your content only as needed to provide, secure and support Zurvey for you and the people you choose, such as your respondents and workspace members. This permission ends when your content is deleted from Zurvey, except for copies we must keep by law or that you already sent to other services.

Templates are starting points. Once you use one, you are responsible for adapting its questions to your purpose.

Forms published from a Free workspace show a discreet Made with Zurvey badge. Pro workspaces can remove it.

If you send us feedback or suggestions, we may use them to improve Zurvey without any obligation to you.

Your responsibilities toward respondents

When you publish a form, you decide what to ask and what to do with the answers. You are responsible, as the party in control of that data, for:

• having a legitimate purpose and a legal basis for the data you collect;
• telling respondents who you are and how you will use their answers, for example with your own privacy notice;
• obtaining any consent the law requires, including the express written consent needed for sensitive data and the consent of parents or guardians for minors;
• only asking for the data you need;
• the destinations you connect, such as spreadsheets and webhooks, and who can see responses in your workspace; and
• answering respondents’ requests about their data, with our help within our role.

Zurvey processes responses on your behalf to provide the service, as described in our Privacy Policy.

Acceptable use

Don’t use Zurvey to:

• break the law or help someone else break it;
• phish, impersonate someone, or ask for passwords, sign-in codes or full payment card numbers in ordinary questions;
• send spam or unsolicited messages, or run fraud or scams;
• upload or distribute malware or other harmful files;
• publish content that is unlawful, harassing, hateful, sexually exploits minors, or promotes violence;
• infringe other people’s intellectual property, privacy or other rights;
• collect personal data without a legal basis, or sensitive data without the consent the law requires;
• get around plan limits, usage controls or security measures, or access other people’s accounts or data;
• probe, scan or test Zurvey’s security without our written permission; or
• overload, scrape or disrupt Zurvey, or copy it to build a competing service.

Plans, limits and fair use

Zurvey has two plans, Free and Pro. Current prices and limits are on the Pricing page.

Forms, questions and responses are unlimited on both plans, subject to fair use. There is no paywall that switches on at a number of responses. Very high sustained volume, such as more than 50,000 valid responses a month for three consecutive months, can lead us to contact you for a capacity review. That review is a conversation; it doesn’t block your next response or start a charge.

Some resources have limits per workspace, including storage, maximum file size, AI generations per month and instant response emails per month:

• when instant response emails run out, you receive a daily summary instead;
• when AI generations run out, you can keep building by hand until the next month; and
• when storage is full, new uploads are paused until space is freed or the plan changes.

Running out of AI generations or instant emails never stops your forms from receiving responses. Sign-in codes and service notices don’t count toward the email limit.

Free workspaces are subject to an inactivity rule. If no Owner or Editor signs in and works in a Free workspace for 24 months, its responses and uploaded files are deleted, even if its forms kept receiving responses. We send reminders 60, 30 and 7 days before. The Privacy Policy explains the details.

Pro subscriptions

Price and billing. Pro costs $9 per month or $90 per year, in US dollars, paid in advance for each billing period through Stripe. Taxes and the final total, if any apply, are shown at checkout. One subscription covers one workspace.

Renewal. Your subscription renews automatically at the end of each period until you cancel it.

Cancellation. The Owner can cancel from the billing page in the app. Cancellation stops future renewals; Pro stays active until the end of the period already paid. There is no cancellation fee.

Going back to Free. When Pro ends, Free limits apply again. Zurvey branding returns on your forms, the custom domain stops serving them and extra members lose access until the plan changes. If you use more storage than Free allows, you get 30 days to download, delete or move files, and new uploads that would add to the excess are paused. There is no automatic deletion when that period ends.

Price changes. We may change Pro prices for future periods. We will tell you by email before a new price applies to your renewal, so you can cancel first if you prefer.

Billing problems. If you think you were charged incorrectly, contact us at hello@zurvey.co with your account email and the invoice. We will correct incorrect or unauthorized charges and provide any refund or remedy the law gives you. You can also use your payment provider’s dispute process or other legal remedies.

Founding Pro

Founding Pro is a rate for Pro, not a separate plan. It costs $60 per year, billed annually, and is available to the first 100 workspaces that pay for an annual Founding Pro subscription. Signing up doesn’t reserve a spot. Availability is confirmed in the app before you pay.

A workspace keeps the founding rate on each renewal while its subscription remains active. If the subscription ends, the founding rate ends with it and the spot doesn’t return to the pool. Changing to a different plan or billing cycle can also end it; the app shows the effect before you confirm. The standard price remains $9 per month or $90 per year.

Payments collected through your forms

You can add a payment to a form by connecting your own Stripe or PayPal account, on Free or Pro. When you do:

• payments go to your provider account, and the transaction is between you and the person paying;
• Zurvey is not the seller or merchant of record for those payments;
• your provider’s processing fees and terms apply, and Zurvey adds no commission of its own;
• you are responsible for your prices, receipts, taxes, refunds, disputes and compliance with the rules that apply to your sales; and
• refunds are made from your Stripe or PayPal account, and Zurvey shows the resulting status.

Payment availability depends on each provider and on your account being approved and connected. A form with a required file won’t take a payment until that file is stored.

Connected services

Zurvey works with services from other companies, such as Google Drive, Google Sheets, Stripe, PayPal and webhook destinations you configure. Each is governed by its own terms and privacy practices. When you connect one, you instruct us to send the relevant data to it, and it becomes responsible for that data once received.

We aren’t responsible for the availability or actions of other companies’ services, but this doesn’t reduce our responsibility for the Zurvey service. If a connected service fails, your responses stay in Zurvey and the app shows the delivery status.

A Pro workspace can connect one custom domain. You must own or control the domain and keep its DNS configured as the app indicates.

AI form generation

You can ask Zurvey to create a first draft of a form from a description. AI generation is optional and has monthly limits per plan. The draft can contain mistakes, questions that don’t fit your purpose or wording that isn’t appropriate for your audience. Review and edit it before publishing. Nothing generated is published automatically.

Don’t include personal or confidential information in your description. As with the rest of your content, you are responsible for the form you publish.

Availability and support

We provide Zurvey with reasonable care and skill. Maintenance, security work, provider outages and network problems can interrupt the service. We will work to limit disruptions and give notice of planned interruptions when practicable. Zurvey doesn’t include an uptime percentage, recovery-time commitment or service credits.

Suspension and closure

We may limit or suspend a form, a feature or an account when it is necessary to stop a violation of these terms, abuse, fraud, a security threat or harm to others, or when the law requires it. We will act proportionately, for example by closing one form rather than a whole workspace when that is enough. We will tell you the reason unless the law or security prevents it, and you can reply to hello@zurvey.co if you think we made a mistake.

We may end this agreement for a serious or repeated violation that isn’t corrected after we tell you about it, or when continuing would be unlawful.

You can stop using Zurvey and delete your account at any time. Deleting an account removes its workspaces and data as described in the Privacy Policy; it doesn’t delete files already in your Google Drive, rows already in your spreadsheets or data already sent to your webhooks.

Exporting and deleting your data

While you have access, you can export responses as CSV and download uploaded files individually or as a queue of individual downloads. Please export anything you want to keep before deleting data, closing your account or when a Free workspace approaches the inactivity date.

Zurvey doesn’t offer restoring deleted data. Items moved to the trash can be recovered for 30 days; permanent deletion can’t be undone.

Zurvey’s rights

Zurvey, its software, design and brand belong to us or our licensors. These terms give you a limited, non-exclusive, non-transferable right to use Zurvey according to them. Don’t copy, modify or reverse engineer Zurvey, except to the extent the law allows despite this restriction, and don’t use our name or logo in a way that suggests we endorse you.

Responsibility

Your legal rights come first. Nothing in these terms excludes or limits liability that can’t be excluded by law, including for fraud, wilful misconduct or gross negligence, or any right you have under mandatory consumer protection law.

We are responsible for providing Zurvey as described in these terms. We aren’t responsible for the content of forms created by users, for how creators use the responses they collect, or for results that depend on choices within your control, such as the questions you ask and the services you connect.

Changes to these terms

We will publish any change on this page and update the date at the top. If a change is material, we will tell account holders by email or in the app before it takes effect. If you don’t agree with the new terms, you can cancel your subscription and stop using Zurvey before they apply.

Governing law and disputes

These terms are governed by the laws of Mexico. If you are a consumer, you keep the mandatory protections of the law of the place where you habitually live. For business disputes where a choice of court is lawful, the competent courts of Guadalajara, Jalisco, Mexico have jurisdiction.

Consumers can use the courts, authorities and dispute-resolution mechanisms available to them, including Mexico’s Procuraduría Federal del Consumidor (PROFECO) where it is competent. We don’t require arbitration, and contacting us first is a practical step, not a condition for bringing a claim.

General

These terms, together with the Privacy Policy and the plan details shown when you subscribe, are the whole agreement between you and Zurvey about the service. If a provision can’t be enforced, the rest still applies. Not enforcing a provision right away doesn’t mean we waive it. We may transfer this agreement as part of a merger, acquisition or sale of assets, and we will tell you if that happens.
